and SWINCO, INC., or either the Client or SWINCO, INC. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal
meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision
of SwinCo, Inc.’s stated services/products, in accordance with and subject to, prevailing United States Law. Any use of the
above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable
and therefore as referring to same.

Privacy Statement: SWINCO, INC. is committed to protecting your privacy. Authorized employees within SWINCO, INC. on
a need to know basis only use any information collected from individual customers. We constantly review our systems and
data to ensure the best possible service to our customers. The government has created specific offenses for unauthorized actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Confidentiality: Client records are regarded as confidential and therefore will not be divulged to any third party, other than [our manufacturer/supplier(s) and] if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the provision that we are given reasonable notice of such a request.
Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.

• We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited
  mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

General

The laws of Nevada govern these terms and conditions. By accessing this website [and using our services/buying our products] you consent to these terms and conditions and to the exclusive jurisdiction of the United States courts in all disputes arising

or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified,
varied or supplemented except in writing and signed by duly authorized representatives of SWINCO, INC.

 

Notification of Changes: SWINCO, INC. reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site.
If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or
postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site

This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

Payment: SwinCo, Inc. accepts the following payment methods:

All major credit cards including American Express, MasterCard, Visa and Discover.

PayPal

Google Checkout

Checks or money orders. However, orders will not ship until we are in receipt of payment.

Purchase Orders- For purchases using Purchase Orders, your company must be approved for credit terms prior to submitting your order. After completing your order online you must fax a purchase order from your company to 919.304.1204. Your order will not process until your company has been approved by our credit department.

Credit Terms - To apply for credit (standard terms Net 30 days); call Customer Support at 1-866-4SWINCO, ext. 1 to request a credit application.

Wire transfers. There is an additional $20 wire transfer fee charged by the banking institution. No refunds will be granted.

Pricing:  For all prices and products, we reserve the right to make adjustments due to errors, changing market conditions, product discontinuation or typographical errors in advertisements. Allegro is not responsible for manufacturer price changes, which may occur at any time without notice. SwinCo, Inc. offers discounted pricing for all products that are purchased in significant volume. Contact Sales at 1-866-4SWINCO, ext. 2 or email sales@biocateplus.com for more information.

Shipping: Most orders will be shipped the same day if received before 2PM EST (excluding holidays). Orders placed on holidays or weekends and after 2PM EST on Friday will be processed the following business day. Shipping costs vary by location.
All shipments are subject to stock availability. Orders within the 48 contiguous United States that cannot be shipped by USPS
or FedEx will be sent by Common Carrier. Customer will be responsible for such costs. SwinCo, Inc. will provide the customer
an estimate of shipping charges prior to processing the order. If Next Day or special shipping requests are required, please
call Customer Support at 1-866-4SWINCO prior to placing the order.

Returns: Please check the accuracy and condition of your order for when it arrives. Please report any discrepancies as soon
as possible. To quickly process your return, please call 1-866-4SWINCO, have your order number available and our customer support representative will provide you with a return authorization number. This return authorization number (RA#) must be
written clearly on the return address label or the label supplied on the packing slip. Return authorization requests should be made within 10 days of the invoice order date.
NOTE: All items must be returned in Manufacturers original box with all instructions, hardware accessories, etc. Item(s) MUST
be in resalable condition and unused. Please DO NOT write the return authorization number or addresses on
Manufacturers box. This makes the item non resalable and credit will not be issued.
Returns are broken down into two categories:

Company Error, Manufacturer's Defect

Customer Error

You must obtain a return authorization number for any of the return categories.
Company Error/Manufacturer's Defect/Damaged Goods

Returns will not be accepted after 30 Days.

Orders returned within 30 days will be credited 100% of the invoiced amount.

If your order was shipped by UPS or FedEx, our customer support representative will contact them for pick-up.
They will arrive within 2 to 5 business days to pick up the order. The pickup tag will have all return address information.
Do not attempt to give the return package to your regular UPS or FedEx driver. They will ask for the return package.

If your order was shipped by common carrier, our customer support representative will schedule a truck to pick-up
the return item. Carrier will arrive within 5 to 7 business days to pick up the order.

Customer is responsible for acceptable repackaging of all returns.

Customer Error/Cancellation
Customer will be responsible for the original shipping costs.

Returns will not be accepted after 30 Days.

Customer will be responsible for all return shipping fees and costs.

Orders returned within 30 days will be credited the invoice amount LESS the original shipping costs & associated fees.

Customer is responsible for acceptable repackaging of all returns.

SwinCo, Inc. will not be responsible for return shipments lost or damaged that are returned by customers.

General Return Policy Notes

All dates are from the date of the invoice.

We will not accept for credit the return of merchandise unless authorized by SwinCo, Inc.

Please DO NOT ship returns freight collect; the warehouse will refuse these shipments.

Customer is responsible for acceptable repackaging of all returns.

Restocking fee: When an item is returned it must be inspected and placed back into inventory. The restocking charge covers
the cost of order processing, packaging and placement back into inventory. Restocking charge is 20% of the total invoiced amount or a $10 Minimum.

Termination of Agreements: Both the Client and the company have the right to terminate any Services Agreement for any
reason, including the ending of services that are already underway.

Availability: Unless otherwise stated, the services featured on this website are only available within the United States, or in relation to postings from the United States. All advertising is intended solely for the United States market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or
any other means, without the express written consent of SWINCO, INC. SWINCO, INC. does not warrant that the service from
this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Log Files: We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information
related to this data will never be used in any way different to that stated above without your explicit permission.
